Shapiro Haber & Urmy Announces The Filing of a Class Action Suit On Behalf of Residents of the City of Gardner Alleging Copper Coil Corrosion

Shapiro Haber & Urmy LLP ( has filed a class action lawsuit against the City of Gardner, Massachusetts, Suez Water Environmental Services, Inc. and AECOM Technical Services, Inc. The suit alleges that Gardner and the companies the City hired to manage its water supply were negligent and they sold, supplied, and distributed corrosive water to Gardner residents and businesses. That corrosive water is alleged to have caused damage to copper heating coils, water heaters, and boilers. Some residents allegedly had to replace copper heating coils on multiple occasions. The class action is brought on behalf of all residents and businesses in Gardner whose copper heating coils, water heaters, and boilers have been damaged by the corrosive water.

The Complaint alleges that Gardner and its water companies have known for years that the water was corrosive and failed to implement their own plan to protect against corrosion that was recommended by City consultants. The Complaint further alleges that the City and its water companies knew for years that they could fix the problem by adjusting the water chemistry through the addition of a orthorphosphate corrosion protector. In August 2017, Gardner announced its plan to add orthophosphates to the water supply. Nevertheless, Shapiro Haber & Urmy claims that as of the time the case was filed, this solution had still not been implemented.
